Pebbles™ Giveaway Official Rules

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

1. SPONSOR AND ADMINISTRATOR: Premier Nutrition Company, LLC, 1400 65th Street, Suite 105, Emeryville, CA 94608 (“Administrator” or “Sponsor”) is solely responsible for all aspects of this Pebbles™ Giveaway (the “Giveaway”) and is the independent judge of the Giveaway. Administrator’s decisions are final and binding with respect to the Giveaway. Sponsor is solely responsible for the purchase and delivery of all prizes.

2. ELIGIBILITY: Open only to persons who, upon entering, are: (a) 18 years or older; (b) legal residents of, and physically located within, the 50 United States or the District of Columbia (collectively, “Territory”); and (c) not employees of Sponsor, its parent, subsidiary, affiliated, or successor companies; Administrator; the advertising, promotional, or fulfillment agencies of any of them (individually and collectively, “Entities”), nor members of their households or immediate families. Each such person may be referred to as an “Entrant”.

3. HOW TO ENTER: The giveaway begins upon Administrator posting the Giveaway post on Instagram and ends on June 5, 2026, at 11:59 p.m. Eastern Standard Time (“EST”). (“Giveaway Period”). To enter the giveaway, you must answer: (a) like the Giveaway post; (b) follow @dymatize and @pebblescereal on Instagram; and (c) comment on the Giveaway post “Happy Birthday Pebbles” and tag a friend (each an “Entry”). There are no limits on the number of Entries each Entrant can submit.

4. LIMITATIONS: All Entries must be received by 11:59 p.m. EST on June 5, 2026. * For purposes of these Official Rules (“Rules”), all times and days are Eastern Standard Time and the Administrator’s computer will be the timekeeping device for the purposes of this Giveaway. In the event of a dispute regarding the identity of the person submitting an Entry, Sponsor reserves full rights to modify or change prize fulfillment. Entries by any method other than set forth above in Section 3 are void. Use of any automated system to enter, as determined by Administrator in its sole judgment, is prohibited and will result in disqualification at Administrator’s sole discretion. Neither the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, “Releasees”) are responsible for Entries from persons residing, or physically located, outside the Territory, or Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, illegible, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misdirected, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Rules; or for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable emails resulting from any form of active or passive email filtering; insufficient space in Entrant’s email account to receive email; or other errors of any kind, whether due to electronic, human, mechanical, printing, production or technical errors or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified, and any attempt by a person to use multiple accounts to register more than once may result in disqualification at Sponsor’s sole discretion. Void where prohibited or restricted by law and subject to all applicable federal, state, local, and municipal laws and regulations.

5. PRIZES: There will be three (3) Grand Prize winners. Each winner will receive one (1) prize package, with an approximate value of $50, awarded at the end of the Giveaway Period. Each prize package will consist solely of:

• 1 tub of Dymatize® ISO100 Birthday Cake PEBBLES™
• 1 box of Post Birthday Cake PEBBLES™ cereal

The prize(s) may not be sold or transferred for commercial use. All expenses not specifically mentioned herein are not included and are solely the winner’s responsibility, including but not limited to standard internet service charges. The prizes are not redeemable for cash. No substitution allowed except that Sponsor may, at Sponsor’s sole discretion, substitute a prize of equal or greater value. The prizes cannot be used in conjunction with any other promotion or offer. The prize(s) will be awarded provided they are validly claimed and the winner’s eligibility is confirmed within forty-eight (48) hours of notification, after which the Administrator may, in its sole discretion, select an alternate winner. In the event the potential alternative winner does not respond within forty-eight (48) hours of notification, the unclaimed prize(s) may or may not be awarded to other alternative winners at the Administrator’s sole discretion.

6. PROCEDURES: After the Giveaway Period ends, the Administrator will randomly select three winners, and the potential winners will be selected from all eligible Entries received. Odds of winning depend on the total number of eligible Entries received.

7. WINNERS: The potential winners will be notified via Instagram direct message after the Giveaway Period. Administrator is not responsible for any incorrect or inaccurate Entry information, theft, tampering, destruction, or unauthorized access to, or alteration of entries; printing or other errors; and/or any entries that are late, lost, delayed, incomplete, misdirected, stolen, mutilated, illegible, received with postage due, or any combination thereof. Administrator reserves the right to modify, suspend, or terminate the Giveaway in the event that doing so becomes necessary due to circumstances beyond Administrator’s control. In the event the Giveaway is terminated early, the Winner will be selected from all eligible entries received at the time of termination. To claim the prize(s), the potential winner will be required to contact the Administrator within forty-eight (48) hours of notification that they have been selected as a winner. At the sole discretion of Administrator, disqualification, forfeiture, and the selection of an alternate winner may result from any of the following: [1] potential winner’s failure to respond to the notification within forty-eight (48) hours after its transmission; [2] the failure of notification due to deactivation of the potential winner’s email account prior to receipt of notification; [3] potential winner’s failure to provide Administrator with satisfactory proof of age, identity, and residency; and [4] any other non-compliance with these Rules. In the event of a prize forfeiture or otherwise unclaimed prize, Administrator may, in its sole discretion, award or not award the forfeited prize to an alternate winner. All taxes are solely the responsibility of the winner.

8. CONDITIONS: By entering this Giveaway and/or accepting any prize you may win, you represent and warrant that: [1] you will be bound by the Rules and Administrator’s decisions, which shall be final in all respects; [2] during the Giveaway Period, you will disclose your relationship with Sponsor in any online posts you make which reference Sponsor or any of Sponsor’s products or services by including a statement with the hashtag “#PebblesGiveaway” in any such online posts; and [3] if you are selected as a winner, you will continue to disclose your relationship with Sponsor in all online posts you make that reference Sponsor or any of Sponsor’s products or services by including “#paid” or the statement “I received a gift from Dymatize®” in any such online posts. By entering this Giveaway and/or accepting any prize you may win, you agree: [1] that your Entry becomes solely Sponsor’s property and will not be acknowledged or returned; [2] to release and hold harmless the Releasees from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of the prize; participation in the Giveaway or any Giveaway-related activity or travel or from any interaction with, or downloading of, computer Giveaway information; and [3] that your selection as a winner and acceptance of a prize constitutes the grant to Sponsor and its assigns of an unconditional right to use your name, address (city and state only), voice, likeness, photograph, biographical and prize information, statements about the promotion and/or live and taped performances of interviews for any programming, publicity, advertising and promotional purposes without additional compensation, except where prohibited by law. The Releasees do not make any representation, warranty, or guarantee, express or implied, relating to the Giveaway or the prizes. In the event of viruses, bugs, unauthorized human intervention, acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism, or other matters beyond Sponsor’s reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of the Giveaway, so that it cannot be conducted as originally planned, Sponsor has the right, in its sole discretion, to modify the Rules or to cancel, modify, terminate or suspend the Giveaway; and in such event, to select winners by such method as Sponsor in its sole discretion shall consider equitable. Releasees are not responsible for typographical or other errors in the offer or administration of this Giveaway, including but not limited to: errors in the advertising, Rules, selection, and announcement of the winners and distribution of the prizes. Releasees are not responsible for any inability of the winner to accept or use the prize (or any portion thereof) for any reason. Sponsor has the right to modify prize award procedures at its sole discretion. Releasees are not responsible for any failure of delivery of winner notification. The Giveaway is governed by the laws of the United States, and, by entering, all winners and entrants hereby submit to the jurisdiction and venue of the federal, state, and local courts located in Oakland, California.
